The Judicial Assignment Act
Noting that the judicial system is a functioning branch of government within the CFN.
Recognizing the lack of of input on who becomes a member of the judicial system.
Also noting the lack of jury within the courts.
Thus recommending:
-That all major judicial positions (Justice, Chief Justice and Judge) be subject to democratic approval by either a popular vote by CFN citizens or Cabinet vote, in the case that a popular vote cannot be held.
-Makes a term in judicial office 3 months, the sole exception being the Cheif Justice, who serves until he/she resigns or is removed from office by unanimous Cabinet vote.
-Leaves the positions of Magistrate and Law Clerk postions of appointment, to be handled by Chief Justice or whosoever he/she assigns to handle the appointment.
-Requires that all criminal cases taken to full trial or appeal within the courts to have a jury of at least three CFN citizens to judge the trial.
-Requires that jury members be impartial, and remain so, during the trial.
-Makes jury duty optional for all citizens.
-Prohibits Cabinet members from serving on jury without approval from the presiding judge.
-If impartial citizens cannot be found to serve on jury, the presiding judge reserves the right to judge the trial individually.
-Allows this bill to be edited, if necessary.
(This bill DOES NOT affect members currently serving in the judicial system)
