Part of the Tyranny Protection Acts:
a series of bills aimed at increasing the regulation of police power and citizen's rights when it comes to dealing with the government
THE GUARD RIGHTS
these rights are to protect any citizen, when dealing with the government or with police of any kind, to abuse of power and illegal acts of deluded authority.
Each Citizen shall be endowed with these rights, which shall be added to the Constitution and shall be known as a citizen Guard Rights.
A citizen may invoke these rights when dealing with the police, and government officials or any type of police and security agency in the Commonwealth.
There must be two conditions met before these rights may be legally invoked as protection. One, The person is being questioned by a police, government official or security agent of the Commonwealth, on the basis of interrogation which is initiated upon reasonable suspicion and or probable cause. The police, government official and or security agent, must have reasonable suspicion that the citizen is might commit a crime and so they may start a conversation already suspecting a citizen. If a citizen is being, then, questioned by one of these parties based on interrogation of an alleged crime then the citizen may invoke these rights. Two, The other part to this is if one of the parties has probable cause to believe you have committed a crime and questions said citizen and or places him or her under arrest these rights may be invoked as well.
Therefore this Bill will require any police, security agent or government official, when interrogating, based on reasonable suspicion or probable cause, and or arresting a citizen based solely on probable cause, to remind the citizen or her or her Guard Rights.
The Guard Rights of Citizen that a citizen may invoke if the above conditions are met are as follows;
Also please note that these rights are a mirror of the United States' Miranda Rights, only tailored for our system.
I.The Right to Remain Silent
A citizen may remain silent as per the rights in our Constitution which protect against self-incrimination.
II.Anything you say can be used against you in a Court of Law
If the citizen, upon being warned with these rights, continues to talk then anything said can be used in a Court for the Prosecution's advantage.
III.The Right to have legal counsel present
Once invoked and the two conditions have been met the citizen has the right to have a Attorney present during questioning and all times involving the police, government officials or security agents.
-The Right to have the courts provide you with legal counsel to represent you in the event that you can not find one
In the event a citizen does not have a person to represent them. The Citizen may appeal to the courts to invoke the right to legal counsel. At which point that courts will notify the police, etc to stop questioning until a attorney can be found.
Each of these Rights serve the same functions as Miranda Rights although, again, for our system.
Also note: Legal counsel for our system will be anyone whom a citizen request to act as his or her attorney. For the Third Right to be invoked the citizen should have the name of a person who they know will represent them. If a police Officer, government official or security agent wished to further interrogate the citizen after the third right is invoked then the citizen's Attorney should be present. If a P.O. Etc..further questions without the citizen's attorney present the case, if filed the the AG will be thrown out, so when questioning does happen there should be more than two peoples present in the chat.
