Part of the Tyranny Protection Acts:
a series of bills aimed at increasing the regulation of police power and citizen's rights when it comes to dealing with the government
THE LAW ENFORCEMENT REGULATION ACT
This Act is to enable citizens in the Commonwealth a chance to not only take part in the game but offer their time to do something great for the Region.
Noticing that the CFN-State Police Act was nullified and truly believing it be beneficial for the region to re-instate it's provisions under a more simpler bill.
Therefore this Bill Re-introduces a similar Bill with the same goals.
This Bill's purpose is to empower certain people in the CFN to act as police officers. And to charge people who commit crimes within the region. This Bill also emphasizes that having such persons to act as police officers, and not soley having government officials to police, would not only keep citizens safe but give citizens a chance to serve in defending their fellow countrymen and the government.
Article I.
The duties of a Police Officer: To serve and protect citizens within the region and within other regions owned by the CFN by apprehending those who violate the rights of any other citizen.
The powers of a Police Officer: To give legally binding orders to apprehend citizens breaking the law and to investigate crimes done or thought to be committed. When a Trooper is encountering a situation where rights are being violated and or a citizen is being hurt in any way criminally said Trooper may give a legal command such as "Stop" or "You are hereby ordered to....". The Trooper will give an order which stops the criminal behavior and or relaxes the situation. The person which the Trooper gives the order to must obey said order, otherwise it is considered a capital crime which will be doubly prosecuted.
^sub-note: A Trooper may only give legal commands, such as the ones above, if and only if upon probable cause, a crime has been committed or is been committed.
^sub-note: In any instance when a citizen calls for a police officer, the office may conduct an investigation to seek clarification on the situation as well as investigate the crime itself. He or she may give the legal command of stop, or any such langue to quite both parties on the RMB or any of the kind. Once the officer as completed the investigation he or she will then will then decide to charge or not charge the citizen with a crime.
Once the Police Officer feels he or she has enough evidence to charge a party with a crime he or she must submit a formal report to the Ministry of Justice. Upon having received the police report it is up to the Ministry of Justice and the Attorney-General(MoJ) to pursue the case in court.
Another power of a Trooper is: Arrest. If a Trooper finds that the person is disobeying their orders to the extent that it causes a riot of sorts, or a serious capital crime is taking place he may place that citizen "under arrest". Meaning that the Officer will simply let the Chancellor know that he is under arrest and the subject will then be ejected from the region and be held in the Division of Corrections Region until he is Arrangement and he provides a plea.
The responsibilities of Police Officer : to take action when, upon probable cause, a crime is being or has been committed to protect and serve the citizenry.
Article II.
The Police Service shall be the Law Enforcement arm under the Ministry of Justice. And the MoJ as full discretion in it's regulation and rules, unless in violation of the law. The Police Service being the LE arm of the MOJ is then answerable to the Chancellor as their Commander n' Chief and may use the Service to aid in national security.
That citizens wishing to become officers must take a test, before given their "badge" and take their oath of office", which shall ask them a few in depth question about our Constitution especially and with special emphasis on the rights of citizens. Upon a passing grade one may become a Office and use a Officer nation to preform duty. Officers, like any other citizen are underneath the law and are subject to that of the same and shall be de-commissioned if a crime is committed by them
Article III.
That Officers have jurisdiction, meaning power to exercise their office, anywhere within the CFN even over those in the military.
Article IV. Official Protocol for Police Officers.
This protocol will work with the Protection of Tyranny Rights Act(PTRA)
When called upon the Police Officer must first
-Relax the situation at hand, by using Order Command Power to stop the parties involved
-Asses the situation at hand, by using the evidence at hand to see what the legal ramifications are
-Investigate the situation, by looking at all evidence and taking witnesses statements( privately)
-Neutralize the situation, by making a police report, filling it with the AG if needed, or by dismissing the parties involved issuing a warning.
R.A.I.N.
Should a Police Officer see the need to arrest a citizen the must file a police report with the AG's Office(MoJ) and tell the Chancellor. Once the citizen in the Corrections Center the officer's job is complete and the courts shall then take it from there.
Officers are not allowed to file their own charges and submit them to court. It should be understood that it's the role of the AG(MoJ) to charge and argue cases.
Also if passed, each Officer along with any other government official or security agent must, upon arrest or before questioning/ interrogation- on the basis of reasonable suspicion and or probable cause- tell the citizen his or her Guard Rights.
